Cary Delays Decision on Stricter Smoking and E-Cigarette Rules
Cary's Town Council has delayed a proposed expansion of the town's smoking ordinance after a 4-2 vote fell short of the five votes needed for approval.
The amendment would have extended Cary's existing smoking restrictions to electronic cigarettes and vaping devices while prohibiting their use in additional public spaces, including town-owned properties, parks and certain indoor businesses.
Although a majority of council members supported the proposal, it did not receive enough votes to pass. The measure could return for consideration as soon as the next council meeting.
🏛️ What Would the New Rules Change?
Cary's current smoking ordinance dates to 2007 and prohibits smoking in town-owned buildings and vehicles.
The proposed amendment would expand those restrictions to include electronic smoking devices, such as e-cigarettes and vapes.
It would also broaden the locations covered by the ordinance, including:
Town-owned buildings and other municipal properties
Public parks and recreational areas
Enclosed public spaces, including retail stores
Under Cary's smoking ordinance, violations can result in fines of up to $50.
The proposed changes would create more consistent restrictions on traditional smoking and vaping in public spaces throughout town.
🗳️ Why the Amendment Didn't Pass
The proposal received four votes in favor and two against, but council rules required five affirmative votes for adoption.
Mayor Harold Weinbrecht and Council Member Sarika Bansal cast the two opposing votes.
Weinbrecht indicated that he supported the overall direction of the amendment but preferred to see the council reach a unanimous decision before moving forward.
Bansal expressed concerns about approving the proposal without additional supporting data and said she wanted more information before committing to the full amendment.
Weinbrecht's decision to vote against the measure followed Bansal's concerns, leaving the proposal one vote short of passage.
🗣️ Public Commenters Express Support
During the meeting, some residents spoke in favor of stronger restrictions on smoking and vaping.
Supporters argued that a comprehensive tobacco-free policy would provide clearer expectations about where smoking and vaping are permitted.
The comments reflected support for extending existing restrictions to electronic smoking devices, particularly in public places where other residents may be exposed.
However, council members did not reach the level of agreement needed to adopt the changes.
📅 What Happens Next?
The amendment remains under consideration and could return to the Town Council at its next meeting.
If council members approve the proposal, the expanded restrictions are expected to take effect July 1, 2027.
Until then, Cary's existing smoking ordinance remains in place, and the proposed vaping restrictions have not been adopted.
The next discussion could determine whether council members can resolve their remaining concerns and reach the five-vote threshold needed to move the ordinance forward.

$25 Million Food Hall Opens at NC State Fairgrounds
The North Carolina State Fairgrounds is introducing a new $25 million food and event hall during the 2026 State Fair, which runs Oct. 15-25. The two-story facility is the first new building at the fairgrounds since 2006 and replaces the former Restaurant Hall.
Once fully operational, the building is expected to include eight permanent restaurants, a bar, indoor dining areas and an outdoor terrace overlooking the midway. During this year's fair, some vendors are expected to serve food through four exterior windows.
The project was designed by Raleigh-based HH Architecture, with details inspired by carnival rides and fair traditions. Decorative lighting and circular seating are among the features intended to connect the building's appearance with its surroundings.
Fair organizers hope the new facility will attract visitors throughout the year, including people attending other events or shopping at the Raleigh Market. Construction took approximately two years, and while parts of the building will be used during this year's fair, full year-round operations are currently targeted for 2027.
