Understanding the NAR Settlement for NC

As you already know, there have been some changes to the real estate industry after the NAR settlement that addressed buyer agent compensation. Many people have questions about it and are very confused about what it means going forward.

Here is a YouTube video that explains how the changes affect us in North Carolina.

The biggest take away points are these:

  • Buyers will be required to sign a buyer agency agreement BEFORE going to see any homes.

  • NC Exclusive Buyer Agency Agreements always stated that we don't work for free... that our compensation is a certain amount and that we will seek to get that compensation from the seller first. The agreement always stated that if the seller does not agree to pay for some or all of the compensation, then the buyer would pay it. 

  • NC Exclusive Right To Sell listing agreement breaks out the listing firm's compensation separate from the buyer's agent compensation... stressing that offering compensation to the buyer agent is not mandatory (nor is there a set amount) and should be a part of the negotiations if you choose to offer it.

  • Compensation will no longer be listed in the MLS, so buyer agents must call the listing agent to confirm whether or not a seller is offering buyer agent compensation and the potential amount. This may affect a buyer's negotiations.

Q: Are sellers still offering compensation to buyer agents in our area? In most cases, the answer is yes thus far. We have not truly seen a change because many sellers understand two things:

  1. the buyer always technically paid the compensation because the seller collected all of the proceeds from the buyer and then distributed compensation from that pot of money

  2. buyers may alter their offers downward if they need to save money to pay for their agent's compensation
